Pursuant to articles 13 and 14 of EU Regulation 679/2016, FONDAPI National Complementary Pension Fund for workers of small and medium enterprises (hereinafter Fondapi or Pension Fund) with headquarters at Piazza Cola di Rienzo, 80/A – Rome, Data Controller, the Fund’s DPO can be contacted at the email address dpo_fondapi@protectiontrade.it, informs you that the processing of your personal data is carried out for the management of your advance payment request; the provision of data is necessary to pursue the mentioned purposes.

The processing will be carried out using automated and manual tools. Personal data, which will not be disclosed, may be communicated to entities responsible for managing complementary pension contributions, to the depositary bank Société Générale Securities Services S.p.A., also through a third-party provider/Fabrick S.p.A. – acting as “Calling” intermediary – which in turn will transmit them to other entities involved in the service, with reference through the link to the Fabrick S.p.A. website page where the privacy notice regarding IBAN Check is available and with indication of other recipients https://www.fabrick.com/it/informativa-privacy-check-iban, for the service of verifying the correct association between IBAN and tax code/VAT number through consultation of credit information systems and interbank information systems; to third parties for the provision of IT and archiving services and to entities whose right to access data is recognized by legal provisions and/or secondary regulations.

Furthermore, during data processing operations, the Controller will know your identification, administrative and contact data. The Controller might also become aware of data that the Law defines as special (e.g., data relating to health status). In this regard as well, we confirm that such data will be processed with the utmost confidentiality.

The legal basis for processing is the response to a request from the data subject, the member’s enrollment in the Pension Fund and the consequent establishment of the associative relationship, as well as legal obligations and the granting of consent for the processing of special data. We also wish to inform you that you have the right to withdraw consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent provided by you before withdrawal. Personal data acquired for the aforementioned purposes will be processed for the duration of the associative relationship and subsequently will be retained to fulfill obligations provided by accounting and tax regulations; such data will also be retained within the limitation periods provided for exercising rights arising from the associative relationship established with the Fund.

The data subject may contact the Controller to exercise the rights provided by the Regulation in their favor and in particular may request access, rectification, updating, blocking, withdrawal of consent in accordance with applicable regulations, limitation of processing, data portability and deletion of the same. The data subject also has the right to file a complaint with the supervisory authority regarding the processing of their personal data. These rights can be exercised by writing to the email address dpo_fondapi@protectiontrade.it.
