Operational Circular for Companies

New Company Registration

On the “Company Registration” page of the Fondapi website, click on “Register the company now“.

The company must complete the registration process and send us the “Personal Data Sheet” which is automatically generated, complete with stamp and signature, via certified email to fondapi@pec.fondapi.it.

Collection of Enrollments

Instructions for collecting the worker's enrollment form

On the enrollment methods page, the Enrollment Form is available in traditional paper version and online enrollment method. The parties responsible for collecting the enrollment are:
  • the company, at the workplace, by the employer, their employees and/or staff, or representatives of the Fund or the signatories of the founding sources (CCNL) if present in the company;
  • the signatories of the founding sources (CCNL) at suitable locations, including the offices of the territorial organizations they adhere to, by their employees and/or staff;
  • the Fund, at its headquarters, through its employees and/or staff;
  • all the parties previously mentioned in spaces hosting institutional activities or promotional activities of the Fund.
The collection of enrollments can be carried out via the website www.fondapi.it (Online Enrollment). The Party responsible for collecting the enrollment (Companies, CCNL signatories, Pension Fund) provides the worker, along with the Enrollment Form, the following documentation, available on the pension fund’s website: The Enrollment Form consists of 5 pages:
  • Page 1: member’s data. In this section, the member’s personal data and all other required data must be entered. If the worker is already enrolled in another supplementary pension fund, it must be indicated in the appropriate space and the Cost Sheet of the originating Fund, duly signed by the worker for acknowledgment, must be attached. Within the box, there is a link to the Covip website where the cost sheets of all Funds are available;
  • Page 2: self-assessment questionnaire. The questionnaire is a tool that helps the member navigate the different investment options. The questionnaire can be completed fully, partially, or not at all. The questionnaire is an integral part of the Form, the member’s signature is mandatory after checking ONLY ONE box related to the type of completion;
  • Page 3: choice of investment compartment, choice of contribution, subscription date and effective date. On this page, the member chooses:
    • the investment compartment to allocate the contributions;
    • the type of contribution they intend to make. Finally, at the bottom of the page, they affix the signature and the subscription and effective date of the enrollment.
  • Page 4: Company data. On this page, the Company’s data must be entered. On the same page, there is also the space reserved for the party responsible for collecting enrollments. This space must be completed by the party responsible for collecting the Enrollment. (In this regard, we remind you that the Fund can be considered the party responsible for collecting exclusively in cases where the member goes directly to the Fund’s headquarters for completion, or this occurs at the workplace during Assemblies where Fund representatives are present, or the enrollment is collected via the website – fondapi.itONLINE ENROLLMENT).
The Form is accompanied by the Information and Privacy Consent (page 5) which must be signed by the member. Once completed, the Enrollment Form must be signed by the member (3 SIGNATURES), by the party responsible for collecting the enrollment (1 stamp and signature in the section on page 4), and sent in original to: Fondapi at Piazza Cola di Rienzo, 80 A – 00192 Rome. Alternatively, the form can be sent via certified email to: protocollo.adesioni@pec.fondapi.it Attention: in case of sending via certified email, the company assumes the responsibility of keeping the original enrollment form at its own headquarters. A photocopy of the identity document of the member must be attached to the form and, if applicable, the Cost Sheet of the originating Fund, signed on each page by the worker, if they are already enrolled in another supplementary pension fund.

Web enrollment method: “ONLINE ENROLLMENT”

The new “ONLINE ENROLLMENT” function is active on the website www.fondapi.it

This enrollment method complements the traditional paper Form completion method (see previous paragraph).

To access the online completion, the member must perform a preliminary “user registration”, necessary to receive an email containing the link and initial access credentials and proceed to the next step of Form completion.

The member must then click on the link contained in the received email (DO NOT ATTEMPT ACCESS directly from the site from the workers’ reserved area, as enrollment is not yet realized at this stage)

In this way, the worker can proceed with the actual completion of the Form.

Once completed, the Form must be printed, signed by the member (3 SIGNATURES), and sent to:

A photocopy of the identity document of the member must be attached to the form and, if applicable, the Cost Sheet of the originating Fund, signed on each page by the worker, if they are already enrolled in another supplementary pension fund (within the online completion method, there is a link to download the Cost Sheet of the pension funds).

The advantages of online enrollment are numerous:

  1. The completion is guided step by step; this significantly reduces the chances of error.
  2. The worker can act completely independently, even from home.
  3. In the case of online enrollment, the Fund becomes the Party responsible for collecting the enrollment and can, therefore, complete the appropriate space on the form on page 4.
  4. The time required for the actual system upload of the enrollment is reduced.

The Fund will notify the Company of the employee’s enrollment through certified email communication, to which a copy of the Form signed by the worker will be attached.

The member who performs the online Enrollment method can exercise the right of withdrawal, within 30 days from the confirmation of enrollment, which will be sent by the Fund to the worker’s email address indicated on the Enrollment Form.

One-time enrollment fee due by member and company at the time of enrollment

For each new enrolled employee, a one-time enrollment fee to the Fund is due, which is divided between the company and the worker according to the sector as indicated in the following table. The payment of the enrollment fee must be made at the first useful contribution deadline, and the communication to the Fund must be made by entering the fee in the contribution statement, according to the indicated methods (see Contribution Statement). In the case of enrollment with only TFR (silent), the part of the enrollment fee borne by the worker will be deducted from the TFR amount being paid, and the part of the enrollment fee borne by the company will be added by the company itself.

"FUTURE ME" Promotion

  1. Promotion recipients:
    • Members of the fund under 41 years old at the time of enrollment
    • Who contribute at least the TFR (Severance Pay)

    • From June 1, 2024, to June 1, 2026
  3. Promotion benefits:
    • Automatic activation
    • Reimbursement of the membership fee for 2 years from enrollment
    • Reimbursement of the one-time enrollment fee borne by the worker
  4. Costs normally borne by the member:
    • One-time enrollment fee: a portion of the €11.36 value (see table above)
    • Annual membership fee: €22
  5. Reimbursement procedure:
    • Automatic for eligible members
    • By the end of the year
  6. Procedure for companies:
    • Remains unchanged
      • They must enter the one-time enrollment fee in the statement, divided between the part borne by the member and the part borne by the company
      • Settle the enrollment fee with the first useful bi-monthly payment
  7. Fondapi’s action:
    • To members who meet the age requirement, it will refund by December 31 the part of the enrollment fee borne by the worker (a portion of the one-time fee) and the membership fee.

Communication method for silent members' personal data

From the website page dedicated to companies and Construction Funds

Within the track, in the first detail field “record_type” the wording must be entered

“S” to identify the silent enrollment type (not “X”).

Communication method for contractual members

The personal data for contractual enrollments must be sent using the same track as silent members.

  • click on “Import Silent Members and Contractual Members
  • click on Download the document with tracks and examples

Within the track, in the first detail field “record_type” the wording “X” must be entered to identify the contractual enrollment type (not “S”).

Once the file is completed, it must be transmitted to Fondapi through the same area “EASY STATEMENT – DATA SUBMISSION” – Import Silent Members.

Determination and payment of contributions to Fondapi

For all employees enrolled in FONDAPI, starting from the month the contributions commence, the company must calculate the contribution amounts on the monthly payslips to be paid (every two months) to the Fund. The contribution to FONDAPI is established by the Founding Sources of the respective sectors. The company must refer to the tables attached to this document and apply the rates provided by the relevant contract.

Contribution Statement

The contribution statement is the tool used for communicating the contributions of employees enrolled in the Pension Fund. It must be prepared bimonthly, according to the schedule set by the fund, and primarily consists of a file constructed according to the rules established by the Pension Fund.

Commencement of Contributions and Requirements for New Enrollments

We remind you that with the entry into force (January 1, 2007) of Legislative Decree 252/05, the commencement of TFR allocation, to be paid to the Fund, is immediate upon the employee’s choice to join, while the contribution (company share and employee share) is allocated starting from the first day of the following month.

For example:

  • Date of signing the enrollment form by the employee: February 12, 2017
  • Commencement of TFR allocation: February 12, 2017
  • Commencement of employee and company contribution allocation: March 1, 2017

ATTENTION:

The commencement of enrollment and allocations is determined by the date the Form is signed by the employee and not by the date the form is delivered and notified to the company.

Therefore, to ensure proper functioning and adherence to timelines, it is necessary:

  1. to promptly send the original enrollment form, completed in all parts, to:
    FONDAPI Piazza Cola di Rienzo, 80/A – 00192 – ROME

  2. Apply, for each new enrolled employee, the enrollment fee to the Fund, which is divided between the company and the employee according to the sector of affiliation as reported in the document Contribution Rates” (Attachment 1). The enrollment fee must be paid at the first useful contribution deadline, and communication to the Fund must be made by entering the fee in the contribution statement, according to the indicated methods (see Contribution Statement). In the case of enrollment with only TFR (silent), the part of the enrollment fee borne by the employee will be deducted from the TFR amount being paid, and the part of the enrollment fee borne by the company will be added by the company itself.

  3. Calculate, starting from the enrollment (as explained above), the contribution amounts to be allocated to the Pension Fund according to the contribution scheme provided by FONDAPI.

Online Contribution Statement Compilation

Selecting the “Online Statement” function allows access to a pre-filled page with summary data of the statement and a detail area with the names of the company’s employees enrolled in Fondapi.

To use this format (strongly recommended), simply follow these steps:

From the website page dedicated to companies and construction funds

  • log in by entering the company’s UserId and Password
  • select “EASY STATEMENT – DATA SUBMISSION” from the menu on the left
  • click on “Online Statement”

The system presents a pre-filled page containing general summary data and details:

General Information Area:
the company will find by default the current contribution deadline bimester, but there is the possibility to modify the competence dates (reference period of the contribution statement) if it is necessary to pay past bimesters; the company must enter the value date on which the payment will be made, and enter the IBAN of the debit account.

Contribution Statement Detail Area:
the names of the company’s employees enrolled in Fondapi appear. The contribution percentages and the amounts related to the contribution must be entered by the company in the appropriate boxes divided by contribution source.

If the company finds the absence of one or more names within the statement, it must verify the correct transmission of the necessary forms (enrollment or other) by contacting the Fund through the channels indicated on the first page of this Circular.

Confirm the data:
Once all amounts have been entered, click the “Confirm data” button: the system proposes a summary screen and an additional confirmation button; only after the second confirmation is it possible to print the submitted statement and the pre-filled bank transfer order.

In case of error:
If the company immediately realizes that it has made an error in the compilation of the already confirmed statement, it is possible, using the “Check your communications” function, to cancel the statement using the appropriate icon.

Contribution Statement Compilation via Excel Format

It involves the use of communication formats in Excel that must comply with strict technical specifications. They can always be downloaded within the company’s reserved area, “EASY STATEMENT – DATA SUBMISSION, by clicking the link: “Submit contribution statement”

Contribution Statement for "CONTRACTUAL CONTRIBUTION"

Within the reserved area “EASY STATEMENT – DATA SUBMISSION” are available the instructions and the format (pre-filled with sample data) for submitting the contribution flow.

To download the formats, go to the homepage of the website www.fondapi.it, enter the section “EASY STATEMENT – DATA SUBMISSION”, log in and from the area “Submit contribution statement”:

  • click on “Download the document with formats and examples”
  • open the “contribution_template”
  • open the folder “Template formats for company contributions with contractual contributions
  • download the instructions “Fondapi WebUploader – Standard Communication Formats – pdf” and the format to be completed “example_contractual_contributions_company.xls”

In the file, it must be indicated as operation type “CT”, which identifies the ordinary and contractual contribution (not “TT”).

The amount of the contractual contribution must be entered in the box “contractual_contribution_amount”.

Attention:
companies that already have members in Fondapi of the “silent” or “collective” type must use the Excel format described here solely for the payment of the contractual contribution. The ordinary contribution statement cannot be used because it lacks the field “contractual_contribution_amount”.

The electronic submission must be carried out in the same area “EASY STATEMENT – DATA SUBMISSION”, by logging in, using the function “Submit contribution statement”.

It will be sufficient to take the completed format and click on “Confirm”.

Submission of the Contribution Statement

The contribution statement files must be transmitted using the service “EASY STATEMENT – DATA SUBMISSION”, available in the companies’ reserved area.

To access the service, it is necessary to have the reserved authentication codes.

In case of loss or malfunction, the function “Recover password” is available on the site. Important: to use this function, it is necessary to have the Company Code at hand.

At the time of submission of the statement, the system performs online formal checks on the file and immediately reports any detected form anomalies; if there are no errors, it confirms the correct acquisition of the data (with great advantage for the company) and allows the printing of the pre-filled bank transfer order to be used for payment at the bank.

The system makes it possible to carry out the required tasks with significant time savings and a substantial reduction in error margins; the technical criteria adopted also allow for the management of personal data communicated in absolute security. Every detail on the characteristics of the application and instructions for its correct use can be consulted in the Online Operating Manual, available on the Web page introducing the service.

Payment of Contributions

The payment of contributions to FONDAPI occurs on a bimonthly basis and consists of a single bank transfer, the amount of which must exactly match the total present in the corresponding contribution statement, including enrollment fees (if any) and contributions.

The bank transfer must be ordered with value date and availability maximum for the beneficiary on the 21st day of the months of January, March, May, July, September, November. If the 21st falls on a holiday, the previous business day should be considered.

All amounts must be credited to the Fund’s collection account, whose IBAN coordinates in the name of FONDAPI are as follows:

Credit Institution: SGSS SpA (Societè Generale Securities Services)

IBAN Coordinates: IT 39 W 03307 01719 000000000474

NO OTHER PAYMENT METHODS WILL BE ACCEPTED (NO CHECKS) even in cases where payment is made by third parties (e.g., bankruptcy trustee, or any other Responsible for insolvency proceedings)

Penalties and Restitutions

For the purpose of regularizing the contribution obligation, in the event of non-payment or late payment, the company is required to pay to the Fund, in accordance with the methods defined by the internal operating rules, an amount equal to the contribution subject to regularization increased by any percentage increase in the value of the Fund’s share, recorded during the period of non-payment or late payment, as well as an additional amount equal to the default interest at the legal interest rate; this last amount is directly allocated to cover the Fund’s administrative costs.”
(Art. 8 paragraph 10 of the Statute)

What to do in case of...

Hiring an employee already enrolled in Fondapi

The employee who had allocated the TFR to a supplementary pension scheme and who, following the termination of the previous employment relationship, has not fully redeemed the position, has 6 months from the date of the new hiring to express their will, provided that the choice, in this case, will not be between allocating the TFR to supplementary pension or maintaining the TFR in the company, but will be limited to identifying the supplementary pension scheme to which to allocate the new accruing TFR.

If the employee already enrolled in Fondapi chooses to join Fondapi also with the new Company, the form: “Continuation of contribution with another company” must be used.

The form, completed by the employee and completed by the company, must be sent to Fondapi either by mail or by PEC to the address fondapi@pec.fondapi.it

The commencement of the contribution will be from the date of hiring.

IMPORTANT:
the presence of the employee’s name among the Fund’s members does not automate the matching of the payment that the company may make. It is necessary to identify the employment relationship between the company and the worker. For this reason, it is essential to receive the “Continuation of contribution” form.

If the company is not enrolled in Fondapi, not having previously enrolled employees, it is necessary to carry out the “Online Registration of New Companies”.

The enrollment fee, in the case of “Continuation of contribution with another company”, is due only for the part borne by the Company.

Termination of the employment relationship of an employee enrolled in Fondapi

Within 30 days from the termination of the employment relationship of an employee enrolled in Fondapi, the company must notify the Fund.

The company must communicate this termination electronically.

It will be sufficient to access the company’s reserved area with the identification codes and then follow these steps:

  • Click on: Company’s members
  • Identify the name of the employee in question
  • In the “Personal Data” section of the employee, the summary personal data are reported; at the bottom right is the link “Termination”.

ATTENTION:
We remind you that different methods of communicating termination, compared to the one we have indicated (for example in the statement, by fax, email, etc.) will not be accepted.

Transfer to the Fund of previous TFR

Previous TFR refers to that TFR, related to an employee, accrued in the company from the date of hiring to the date of enrollment in the supplementary pension fund.

If an employee requests it, it is possible, in agreement with the company, to transfer the previous TFR to Fondapi.

Below is the form available for printing and completion: “Transfer of previous TFR“.

The form signed by the employee and completed by the company with all the required data must be sent to Fondapi via PEC to the address fondapi@pec.fondapi.it. A copy of the bank transfer made must be attached to the form.

We remind you that for the payment of the previous TFR, the company MUST NOT produce and send any contribution statement. The amount MUST NOT even be included in the ordinary bimonthly statement.

The form and the copy of the bank transfer sent to Fondapi in the manner described above are sufficient.

Payment of productivity bonus

Refer to the “Manual on the Procedure for communication and payment of welfare contributions and the performance bonus available on the site in the Companies and Funds Section.

One-time voluntary contribution through the employer

At the employee’s request, it is possible for the company to pay part of the salary directly into their pension position in Fondapi.

The form to print and complete “Additional contribution through employer”.

The form signed by the employee and completed by the company with all the required data must be sent to Fondapi via PEC to the address fondapi@pec.fondapi.it.

We remind you that it is mandatory, on the part of the company, to include the contribution in the contribution statement to be transmitted to Fondapi through the usual electronic channels and to make the payment of the amount equal to that of the statement.

Suspension of contribution for leave, maternity, leave, etc...

To communicate to the Fund periods of contribution suspension due to: Unpaid leave, leave of absence, maternity, etc., it is necessary to use the Form: “Involuntary suspension of contributions.”

The completed Form must be sent to Fondapi by mail or by certified email to fondapi@pec.fondapi.it.

Please remember that it is necessary to attach documentation certifying the reason for the suspension of contributions.

Payments in case of wage guarantee fund

The severance pay (TFR) accrues even in situations related to both ordinary and extraordinary wage guarantee fund procedures. Therefore, even under these conditions, employers are obliged to pay the TFR to the Pension Fund for enrolled workers.

Regarding the contribution to be paid to the Fund, it is specified that it is necessary to refer to what is provided by the National Collective Labor Agreement (CCNL) for this specific purpose (CIG or CIGS) or to the wage guarantee fund agreement.

In case there are no details in this regard, it should be considered that reference should be made to the parameter that in each CCNL is set as the basis for calculating the contribution.

If it is represented by the TFR tax base, the contribution is normally also due since the TFR, as already specified, accrues. If the parameter is instead represented by the hours actually worked, it is clear that the contribution will be due proportionally.

Please note that the amounts paid as TFR can be subsequently recovered by the employer from INPS.

This certainly happens in the case where the company proceeds with a request for a “payment on balance”. In fact, in this circumstance, the amounts are advanced by the employer and recovered by them through the DM 10 form, deducting them from section “D”.

In the case where the company requests “direct payment”, it has been possible to verify that in the form made available by INPS (SR41) there is no reference to supplementary pension schemes, and this could result in the TFR amounts being paid directly to the worker, thus resulting in a contribution omission by the employer towards the worker enrolled in the pension fund. We would like to point out that a query has already been forwarded to INPS regarding this matter. While waiting for the response, we would like to remind you that the employer is always required to pay the TFR and contributions in all cases where they accrue.

Corporate transformations and/or insolvency procedures

In the event that Insolvency Procedures (Extraordinary Administration, Preventive Arrangement, Bankruptcy, etc.) occur with respect to the company, the Fund must be promptly informed through a communication (by the Curator and/or Liquidator Commissioner and/or Judicial Commissioner and/or Labor Consultant, etc.) to which is attached a copy of the bankruptcy judgment, approved decree, updated chamber of commerce registration, etc.

The Fund, upon receiving the documentation, will implement the procedure provided for in these cases, namely sending updated contribution statements to employees for permitted uses (application for admission to bankruptcy liabilities, registration in creditors’ lists, etc.).

In the event of corporate transformations (Transfer of business unit, Merger and incorporation, Transfer of activity, etc.) it is necessary to promptly notify the Fund through a communication on letterhead signed by a Manager / Legal representative in which at least the following data are highlighted:

Company Name and tax code of the two companies involved (outgoing and incoming); effective date; involvement and transfer of employees (also indicating their name, surname, tax code).

The incoming company must specify the applied CCNL and, if the requirement exists, must also specify the taking charge of workers and the continuation of contribution payments to Fondapi; moreover, if it is not already registered with Fondapi, it must carry out the “Registration online new company” on the website, taking care to transmit the Personal Data Sheet that is produced at the end of the operation, complete with stamp and signature.

Possibility of maintaining the original pension fund

We point out that Covip, with the Interpretative Guidelines approved on September 17, 2009, specified that, in case of transfer of a business unit, the requirements for participation in the pension scheme do not cease if there is an agreement regarding the commitment, both of the employer and the company union representatives, to continue the contribution to the collective pension schemes to which the workers are enrolled.

This commitment must be formalized in a specific company collective agreement that must, clearly, be between the employer and the trade unions.

In this way, absolute continuity in the participation of members in the pension funds of original membership is guaranteed and there is no loss of the requirements for participation in the Pension Fund.

Covip has also specified that this approach (maintaining the original pension fund based on a specific collective agreement) should be followed in all cases falling under art. 14 paragraph 5 of Legislative Decree. 252/2005.

Therefore, in extreme summary, if events occur that involve a change in the corporate structure (e.g., sale of business unit, transfer of business unit, etc.) which would result in the loss of the requirements for participation in the pension fund, it is possible to agree on maintaining the original Pension Fund in a specific company collective agreement specifying the conditions and methods of contribution applied (a template of the Agreement is available in the forms section).

Consultant operations

Accreditation

The CONSULTANT who operates for a single company registered with Fondapi will use the company’s code and password for sending lists and/or electronic communications.

The CONSULTANT who operates for multiple companies registered with Fondapi can register through the online company registration by clicking on “Online company registration” and then choosing the “Consultant” option.

This way, they will receive the access password to the system shortly.

ATTENTION:
We remind you that it is always necessary to first register the new company online with Fondapi (if it is not already registered) for which the Consultant operates. The contribution position, in fact, must be opened in the name of the company, not the consultant.

Through the “online consultant registration”, you can receive a password that will only enable you to send a single contribution track in which you will insert the data of multiple companies simultaneously, provided that the companies inserted in the track are already present in the Fondapi database and that the data contained in the track can only be matched in the presence of the contribution position in the name of the Company.

Compilation of the multi-list

To generate contribution lists for multiple companies, the CONSULTANT must use the multi-list track; it can be downloaded by clicking on the link “Simplified list and multi-list” present in the “Companies and funds area” section.

Sending the multi-list

Once the multi-list has been compiled, it is necessary to save it on the PC (desktop or other folder). The contribution list files must be sent to FONDAPI using the EASY LIST – DATA SENDING service, available on the homepage of www.fondapi.it.

To access the service, it is necessary to have the reserved authentication codes – received during the “Accreditation” phase (see above) and thus proceed by clicking on “Login” until accessing the “Send contribution list” section.

The CONSULTANT, if they have uploaded multiple contribution lists for multiple companies, can:

  • directly make the corresponding bank transfers (matched respectively to the compiled lists)
  • forward the corresponding bank transfer form to the companies so that the companies themselves can make the payment at the bank.

The system makes it possible to execute the required tasks with considerable time savings and a significant reduction in error margins; the technical criteria adopted also allow for the management of communicated personal data in absolute security. Every detail on the characteristics of the application and instructions for its correct use can be consulted in the online Operating Manual, present on the Web page introducing the service.

Contribution rates

Determination of monthly contributions

For all employees enrolled in FONDAPI, starting from the month of contribution commencement and on a monthly basis, it is necessary to determine the amount of contributions to be paid to the Fund. The contribution to FONDAPI is established by the Founding Sources (National Collective Contracts) of the individual sectors of belonging. The company can refer to the schemes shown below that incorporate what is established by the CCNLs and apply the rates provided by the reference contract.

The payment to be made consists of:

  • the TFR quota: “tacit” for workers who have joined by silence/assent; “explicit” for those who have joined by voluntarily signing the membership form;
  • employee’s contribution (if the worker has chosen to also pay the rate at their own expense);
  • employer’s contribution (if the worker has chosen to also pay the rate at their own expense)

  • “Fondapi Remuneration” = minimum tables + distinct element of remuneration + executive function allowance and remuneration element for 8th and 9th category.
  • “TFR Remuneration” = remuneration taken as a basis for calculating the severance pay

ATTENTION:

starting from 1/01/2022, a monthly contribution of €5.00 (adjusted on a base 100) is established at the employer’s expense to be paid to Fondapi for each worker employed as of 1/1/2022.

For workers enrolled in Fondapi as of 1/1/2022, this contribution is additional to what is provided for ordinary enrollment.

For workers who are not enrolled in Fondapi as of the same date, the aforementioned contribution entails their contractual membership to the Fund, without any further obligation on their part. Only INPS solidarity contribution is due on the above contribution.

Recovery Plan

Every recovery plan must be agreed between the Company and all enrolled workers or by trade union representatives delegated by the workers themselves.
In the absence of such agreement, it cannot be accepted.

This note aims to indicate the operational practice suitable for Fondapi to accept the recovery plan because the impromptu definition of procedures by the parties has often hindered matching activities (incomplete operations, plans defined on the basis of partial data, sending of cashier’s checks not manageable by Fund procedures, etc.).

  1. The company that wishes to agree on a recovery plan must request from Fondapi an extract with the list of contribution statements sent but not invested.

    The email request must contain “RECOVERY PLAN REQUEST” in the subject line and be sent to fondapi@pec.fondapi.it.

  1. Following the response from the fund, the company must check the evidence provided and, if necessary, supplement or rectify the pending statements by replying to the same email.

  2. Once the company’s debt is shared, it must propose to the Fund a recovery plan that observes the following rules:
    • The plan must provide deadlines and timing for transfer payments that refer to statements starting from the oldest ones;
    • That transfers correspond exactly to the amount of the statement or the sum of statements they refer to if more than one;
    • That the description of the bimonthly period to which it refers is present in the transfer
    • That you send us an email to fondapi@fondapi.it and for information to fondapi@previnet.it with notification that a transfer has been executed as per the deadline provided and contained in the recovery plan.

Once the recovery plan is started, in case of transfer/redemption/retirement requests, the existing amounts on the pension account as of the request date will be liquidated.

Should the death of one of the workers included in the plan occur, the company may be given the option, in case the heirs request the benefit, to fully settle the member’s position.

The Fund will provide, upon company request, an update of the values indicated within the recovery plan by removing the deceased’s position. The operation will be carried out by the Pension Fund which will then communicate the plan revision to the company.

The plan revision will be considered in all respects a mere update of the amounts of the recovery plan signed by the Parties which remains in force.

Additionally, we note that:

The regularization of a single position is possible in one solution (a single transfer), and in case of multiple contribution statements, of an amount equal to the sum of the statements themselves (for this reason Fondapi transmits the contribution extract of the workers examined for regularization with evidence of the contribution lists awaiting transfer).

We consider it in everyone’s interest that the positions of members not accompanied by full contribution should have the same treatment from time to time and that therefore any payments concerning unmatched periods should be made starting from the oldest positions and for all employees. Should the company decide to proceed for its own reasons, assuming full responsibility, to payment of amounts concerning one/more positions with precedence over others, we consider that it has correctly informed the workers excluded from such practice and decision.
